Appeal allowed following Sanderson’s Written Evidence
Sanderson Associates recently provided written evidence in support of a planning appeal to remove a condition imposed by Kirklees Council on the development of one dwelling near Holmfirth.
This condition related to the provision of a footway around the development frontage and evidence was produced on the technical merits of the required footway and the improvements suggested by the Council that would be brought about by its provision.
In her determination the Inspector Jean Russell MA MRTPI in allowing the appeal commented, “Condition no. 7 is not necessary to make the development acceptable and so it is unreasonable. Removing the condition will not cause an unacceptable loss of pedestrian or highway safety – or conflict with UDP Policies D2 or T10 or the Framework”.
