Successful Planning Appeal – with Award of Costs
Sanderson Associates has recently assisted MWP Planning by providing evidence in a planning appeal against the imposition of a condition relating to the continued extract of sandstone from Windy Ridge Quarry, Cartworth Moor, Holmfirth.
The disputed condition imposed on the Appellants by the Local Planning Authority required an annual condition survey and financial contribution towards the maintenance of a public highway, which had been in use by the quarry since it came into operation in the 19th century. No increase in vehicle size or level of movements were proposed above those already approved by the LPA in recent years.
Detailed evidence to rebut this requirement was provided by Bob Greenwood of Sandersons to support Chris Ballam of MWP Planning with the appeal and the Application for Costs against the Local Planning Authority.
The appeal, determined on the basis of Written Representations, was allowed with the Inspector finding in the Appellants favour both the merits of the technical evidence and also the Award of Costs.
